Privacy, terms and conditions

PRIVACY NOTICE
In accordance with the Laws in force in the Republic of Panama, as well as the regulatory standards, we request you to carefully read these Terms and Conditions, which shall apply to any type of personal and/or sensitive information collected by the company with which you have a direct or indirect relationship (commercial, labor, civil, regulatory, or of any other nature), by virtue of the services provided.
CONSCIOUS BUSINESS CENTER INTERNATIONAL S.A. (Controller) declares to be a legally registered company in accordance with Panama law, with the address at Condado del Rey, Mi Condado Plaza Piso 1, Oficina No. 7, Panama City, Panama. E-mail: privacidad@cbcinternational.org

DEFINITIONS
For the purposes of this Privacy Notice, the following definitions shall apply:
"Database" The ordered set of data of any nature, whatever the form or modality of its creation; organization or storage, which allows relating the data to each other, as well as carrying out any type of processing or transmission of these by its custodian.
"Data blocking" Refers to the temporary restriction of any access to or processing of stored data.
"Anonymous data" Means data whose identity cannot be established by reasonable means or the link between it and the natural person to whom it refers.
"Outdated data" Data that has become outdated by law, due to the fulfillment of the condition or expiration of the term indicated for its validity or, if there is no express rule, due to a change in the facts or circumstances that it contains.
"Dissociated data" Data that cannot be associated with the owner due to its structure, content or degree of disaggregation.
"Personal data" Any information concerning natural persons, which identifies them or makes them identifiable.
"Sensitive data" Data that refers to the intimate sphere of its owner, whose improper use may give rise to discrimination or entail a serious risk for the owner. By way of example, revealing aspects such as race or ethnicity; religious, philosophical and moral beliefs or convictions; union membership; political opinions; data relating to health, life, sexual preference or orientation, generic data or biometric data, among others, subject to regulation and aimed at uniquely identifying a natural person.
"ARCO Rights" These are the rights of access, rectification, cancellation and opposition.
"Right of access" It is the right of the Data Subject to know about the Personal Data related to him/her that are in the possession of the Controller in question or its Processors, as well as to whom they have been shared and for what purpose.
"Right to rectification" Each Data Subject has the right to have his/her Personal Data rectified when it is inaccurate or incomplete.
"Right of opposition" The Data Subject has, at all times, the right to request, provided he/she has a legitimate cause, that the Controller stops handling his/her Personal Data.
"Responsible person" Natural or legal person, public or private entity, for profit or not, that is responsible for the decisions related to the processing of data and that determines the purposes, means and scope, as well as issues related to these.
"Data subject" Means the natural or legal person, owner of the Personal Data, or authorized to provide Personal Data of a third party in accordance with the applicable laws, who provides such Personal Data to the Controller.

PERSONAL DATA COLLECTED AND ITS PURPOSE
Personal data are all those that the Data Subject may provide to the Controller through the following documents, whether they are in print and/or digital format and/or Internet page, which are enunciative but not limited to: names, surnames, addresses, personal identification or passport number, place and date of birth, telephone numbers, e-mail addresses, payment method information, credit card, debit card or bank account numbers; all information that the Data Subject has provided and/or will provide to Controller throughout the civil, commercial, administrative, labor or commercial contractual relationship established with the Responsible Party, by operation of law, by court order or competent authority or any other source permitted by law; shall be used as described below, by way of example but not limited to:

  • Personal data may be handled and used by the Controller to carry out activities related to educational and marketing purposes as the case may be and/or derive from the provision of services, as well as to identify you, locate you, communicate with you, contact you and send you information.

"Use of cookies and web beacons" They will be used to collect information about the owner's preferences.
Once the Data Subject provides Data Controller his/her Personal Data or Sensitive Data, we indicate by means of a checkbox (mandatory) that we will use his/her data to carry out marketing actions.
Personal data will be kept in different secure media that technology allows, and access to it will be limited only to individuals and/or legal entities with which the Controller has a contractual or legal relationship. The data is stored in a proprietary system, which is restricted to CBC staff only, and is entered with an email and password. In case an authority requests, the Personal Data and/or Sensitive Data may be made available to them, in strict compliance with the Law.
The processing of your Personal Data, which has been made available to the Controller under any form or circumstance, may be used by the Controller in accordance with these terms and conditions, so that from this moment it is understood that the Data Subject expressly authorizes the Controller for this purpose, until such time as the Data Subject expresses his/her opposition through any of the procedures indicated in this notice.

OWNER'S CONSENT
The Data Subject declares that this Privacy Notice has been made known to him/her by the Controller, has read it, has become familiar with it and has understood the terms set forth in this Privacy Notice, and therefore grants his/her consent regarding the processing of his/her Personal Data.
In the event that the Personal Data collected by the Controller includes sensitive Personal Data, in printed format or using electronic media, it shall constitute the express consent of the Data Subject and therefore he/she grants his/her consent for the Controller to use his/her information in accordance with the provisions of this Privacy Notice. In the event that the Data Subject does not object to the terms of this Privacy Notice within the following thirty (30) days in which it was made available to him/her, it shall be deemed agreed and consented in all its terms, clarifying that the consent of the Data Subject may be revoked at any time in accordance with the procedure indicated below.

MEANS OF EXERCISING RIGHTS OF ACCESS, RECTIFICATION, CANCELLATION OR OPPOSITION
The Data Subject shall, at all times, have the right to request from the Controller the exercise of the rights conferred by the Law, except when they are in data blocking, during such period, their Personal Data will not be processed and after this period, they will proceed with their cancellation in the corresponding database or file.  
The user can unsubscribe immediately by clicking on the link at the bottom of the message.
The CBC does not share information with third parties, but in the event that the Personal Data had been transmitted prior to the date of rectification or cancellation and continue to be handled by third parties, the Controller will inform the third party in question of the request for rectification or cancellation, so that it can also proceed to carry out the rectification or cancellation. 
The Data Subject may at any time oppose and/or cancel the processing of his/her personal data that may and/or could affect and/or restrict the fulfillment of the contractual and/or commercial relations in force with the Data Controller.
If you wish to delete all your data from our database, the request must be sent in writing to the following e-mail address: privacidad@cbcinternational.org, and it must contain the following information: 

  • Full name of the Data Subject, the documents proving his/her identity (simple copy in printed or electronic format of his/her personal identity card or passport).
  • Telephone number where you can be reached.
  • E-mail, if different from the one sending your request.
  • Specific description of the subject matter of the request.
  • The reasons on which the request is based.
  • Any other element or document that facilitates the location of the Data Subject's Personal Data. 

The Responsible Party's response will be sent within fifteen (15) working days through the same means requested.
The filing of a request of opposition to the use of Personal Data by the Data Subject shall give the Controller the right to oppose the use of the Personal Data that the Data Subject has provided.

MODIFICATIONS TO THE PRIVACY NOTICE
We reserve the right to make changes or updates to this privacy notice at any time, in order to comply with new legislation, internal policies or new requirements for the provision or offering of our services or products, so it is the responsibility of the Data Subject to periodically review the content of the Privacy Notice on the website www.cbcinternational.org/privacidad in case the Data Subject does not express any opposition with the modification, the Responsible will understand that the Data Subject has read, understood and agreed to the terms set forth, and which constitutes his/her express consent to the changes established regarding the processing of his/her Personal Data.

MARKETING GUIDELINES FOR PROTECTION AND7OR USE OF THE TRADEMARK CONSCIOUS BUSINESS CENTER INTERNATIONAL

  • Do not publish zoom photos with images of program participants or sessions that belong to the training process of any of the CBC programs on social networks. 
  • Do not make videos with photo content or images of the participants that can be uploaded to networks. For example: videos for Tiktok, Instagram or Facebook. 
  • Do not use images of the programs, images of videos or texts included in any of the contents of the CBC programs that are not public in any media.
  • If you use a CBC logo, you can use the CB Coach and/or CB Master Coach logo granted by CBC for your professional services.
  • Do not use the CBC logo in any external program that is not validated beforehand by CBC or that involves being a strategic program as a business partner.
  • Do not use the name of Conscious Business Center International in certification programs and/or professional services if it has not been validated by CBC.
  • In case you are authorized to share publications, do not use graphics or videos posted on CBC's social networks in your own way, you should not edit them in any way

DECLARATION
I hereby declare and confirm that all the information provided in this form, including any documents attached to it, is true, complete and correct. I also state that the funds used to pay for the services offered have not been obtained from any illicit activity and have been obtained from completely legitimate sources.
